These terms are the agreement between you and us when you use Keystimate. By using it you accept them; if you use it for a company, you accept them for that company too.
The service
Keystimate is an online planning poker tool at keystimate.com, run by Arminas Grigonis, Vinčų g. 2, LT-46298 Kaunas, Lithuania (“we”, “us”). You can create and join rooms without an account; an account adds history, organizations and saved rooms. We keep improving the service, so features may change, and we may stop offering a feature or the service with reasonable notice.
Your account
- An account is for one person. Keep access to your email or Google account secure: whoever controls it controls your Keystimate account.
- You must be at least 16 to use Keystimate.
- You can delete your account at any time from the dashboard. What that removes is set out in the privacy policy.
- Organizations belong to their owner. Admins manage members, roles and settings, and members of an organization can see its shared history as its settings allow.
Acceptable use
Don’t use Keystimate to:
- post illegal, hateful, harassing, sexually explicit or violent content in rooms, chat, notes, names or avatars, or content that infringes anyone’s rights;
- harass or impersonate other people, or join rooms you weren’t invited to;
- disrupt or overload the service, get around its limits, guess room codes, or probe it for weaknesses without our written permission;
- scrape, copy or resell the service, or use automated means to access it other than through its normal interface;
- spread malware, or send spam through invites or sign-in emails.
Hosts can remove people from their rooms. We may remove content and suspend or close accounts that break these rules, without notice where the harm is serious.
Your content
What you put into Keystimate (tasks, votes, chat, notes, images) stays yours. You give us the permission we need to store it, show it to the people in your rooms and organizations, and process it as described in the privacy policy, only to run the service. You are responsible for having the right to share what you upload, including issues you import from Jira.
Plans, trials and payment
Keystimate is free to use without an account and with a free account. Paid plans (Team and Keyholder) add organization features, longer history and analytics. Creating an organization starts a free trial of 28 days, once per person; at the end of it the organization keeps its data but loses paid features until it is on a paid plan.
When paid plans can be bought, our order process is run by our online reseller Paddle.com, who is the merchant of record for all our orders. Paddle provides customer service for payment questions and handles returns, and its buyer terms apply to the purchase. Subscriptions renew automatically until you cancel; cancelling stops the next renewal and you keep the plan until the end of the period you paid for. Prices are shown before you buy, including any taxes Paddle has to charge. Refunds follow our refund policy.
Other services
Some features connect to other services: Google sign-in, GIPHY in the chat, and Jira for importing issues and writing estimates back. Their own terms apply when you use them, and we aren’t responsible for them. Availability and warranty
We work to keep Keystimate running and your data safe, but the service is provided “as is” and “as available”, without guarantees that it will always be available or free of errors. Live rooms are held in memory: an unexpected server failure can end a meeting and lose its chat and notes. Estimates are your team’s own judgement; we are not responsible for decisions made with them. Nothing in these terms limits rights you have as a consumer under the law of your country that cannot be waived.
Limitation of liability
As far as the law allows, we are not liable for indirect or consequential loss, such as lost profits, revenue or data, and our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and €100. These limits don’t apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, fraud, or harm caused intentionally or by gross negligence.
Ending the agreement
You can stop using Keystimate and delete your account whenever you like. We may suspend or end your access if you break these terms, or if we stop offering the service, in which case we will give you reasonable notice and a chance to export your data, and refund any unused part of a paid period.
Governing law and disputes
These terms are governed by the law of Lithuania. Disputes go to the courts of Lithuania. If you are a consumer, you also keep the protection of the mandatory law of the country where you live and can bring a claim there. Please write to us first: most problems are quicker to solve by email.
Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change matters, we will tell you in the app or by email before it takes effect; if you keep using Keystimate after that, the new terms apply. Questions: [email protected].
